Remember that scene in the forest near the end of Mel Brooks' "Young Frankenstein"? Where the peasants were chasing the monster through the foggy forest?
Well BOA is at it again. The little moratorium on foreclosures is officially over in states where there are judges who hear these things. These aren't federal cases. They are settled in little local courts with generally elected judges who have been doing foreclosures for years.
I'm pretty sure BOA won't bring up the fraudulent affidavit aspect to their filings - that there is a good chance (over 50%) that any foreclosure filing has a false affidavit in it, now the fact that those downstream of BOA are walking into Federal Court as we speak with law suits claiming fraud...naw we won't hear about that. Mostly we won't hear that the guy who BOA is foreclosing on probably put up a couple mortgage payments in tax guarantees that BOA would be "backed up" in case it failed. If BOA were a bank it would be 10 feet under water.
